I have my sentencing hearing this friday. I spoke with lawyer today who said I am looking at minimum of couple months. I mentioned that I guess I should make plans to send my kids to family down south. Their reply "Yeah, so we don't have to" Now I was pretty upset at that point and didn't ask exactly what they meant by that. I have family that lives next door who could watch the kids. Only problem is one is handicaped in a wheelchair, and the other has medical problems to include vision problems. The other family is a couple states away; younger and able bodied.
Will the courts send someone after my kids if I do get jail time? Or will it suffice to tell them I have made arrangements for them. I'd rather keep them close and know that they'd be okay there. Plus they could come back to their home to get things easily. The other place they be limited. Would the courts question my choice as to where they go? Can they demmand I tell them where I did send my kids.
I mmust add that my case itself has been like a witch hunt. others do what I did, but they are not charged with anything. It's like they decided they didn't want me doing it so they used their "judgement" to say I was doing wrong. Anyway, I am worried more so now about my kids than going to jail...but not looking forward to months in jail over this crap either.

I dont know about your care system, but here although the person in the wheelchair is probably capable of looking after the kids, I dont think it would be a good idea to place the kids with them, here the system would probably whisk them away.

Pony as I write this, you have only today Wednesday andtomorrow Thursday to arrange for someone to look after your kids when you have to take care of your legal business. I am wondering(because I have no expertise)in your state and your county`s child social services department and whether they will take legal custody of them upon your conviction. Remember, you are convicted until the judge sentence you. It is at that time only, that social services can step in and take your children, legally, if no other adult relative is in your home when sentenced.

Whatever you do("This is what I would do) if I were in your shoes at this time. I would write a "Power of Attorney" short letter addressed to whoever you chose to care for the kids. Just write on top of a page "Power of Attorney". Then explain that you give that power only until you come home. Who ever takes the kids will have your permission to care for the children in an adult manner.. You will have to make
your own requests in this letter.

The reason I would do this is because whoever takes the kids without a specific understanding from you may come back to haunt you..Protect your self with written document. signed by parties involved. Made extra copies just in case. When someone mentioned to you, "Good so we don`t have
to" probably meant social services. Pony,it could not have meant anyone else! THEY WILL TAKE
YOUR KIDS UPON CONVICTION. A mother`s instinct is in your post Pony, and I think you understand that you may not leave these disabled children unattended by just anyone.

Put whatever you are doing down and get busy taking these kids to a safe place, no matter where, ("that`s what I would do").

I am sorry for my straightforwardness. But that`s the closes I can see this and am telling you("what I would do")..I am not tell you what to do.

Rolando, PM sent. I just don't like being paranoid, but sometimes a person's "spidey senses" just tingle so much and you don't want to over-react. Plus, I have been through so much with this case and documented lies on the part of the police; that I don't really know how far they will push things to make me miserable.
