He was rational enough to pre meditate the killing and the place to hide to shoot as many as he could.

Going to war to kill for us for a reason, then come home and kill your own, means to me he fought the war because he liked killing and obviously anyone. He was the anti american not us. Terrorist means killing of many thru your own private war on humanity,was not a declared war by the people.

Please do not mistake that i would have any doubt about his guilt or how to value what they have done. I have solely the ethic aspect in mind when i reflect about the societies abilities to punish. And there are better options than doing the same the offender has done.

If that state by majority vote of the people for the people in that state, votes to not have a death penalty and support them the rest of their lives, that is that states right. Yet, on the other hand,they kill an other inmate/inmates or staff that is on that state too.

Peanut, did i understand you well ? When he would have committed the same crimes in a non-DP state then would it be okay that he would have gotten LWOP instead the DP ?

In your country the Gov decides no DP. In the US it is acceptable. yet allows each state by the majority to apply the DP or not in their state. Done by the voters of each state for the individual state only, to use or not. Also many murders go on inside, inmate to inmate that do not come to public attention many times. Majority of the states still vote yes for the DP.

Veteran of war means he served his country during the war - ie he was in the gulf war doing whatever his job assignment was.

Prisoner of war means held captive by the enemy (country we are fighting).

He was a veteran ... Not a prisoner of war.
