Ohio Executions Put on Hold; Governor Concurs

Lawrence Reynolds, who was scheduled to be executed on October 8 in Ohio, received a stay today (Oct. 5) from the U.S. Court of Appeals for the Sixth Circuit. The court's stay was based on unresolved issues in Ohio's lethal injection protocol that were brought to the surface by the unsuccessful execution of Romell Broom on September 15. The majority wrote: "These disturbing issues give rise to at least two questions: first, whether Ohio is fully and competently adhering to the Ohio lethal injection protocol given (a) their failure to have a contingency plan in place should peripheral vein access be impossible, (b) issues related to the competence of the lethal injection team, and (c) other potential deficiencies; and second, whether these instances present sufficient new, additional factors to revive Reynolds’ Eighth Amendment claims otherwise extinguished by Cooey II (an earlier lethal injection challenge).”

In his concurring opinion, Judge Cole noted that Ohio cannot undertake another execution until it has been resolved whether "Broom has already suffered an Eighth Amendment violation by being subjected to this failed execution attempt. Even if Reynolds’ execution similarly was halted partway through, at that point he already may have suffered constitutional harm under Ohio’s protocol. Although the details of the failed Broom execution have not yet fully emerged, the initial reports suggest that the execution attempt could provide uniquely relevant evidence in support of the proposition that there is a 'demonstrated risk of severe pain' under the revised Ohio protocol. Following the stay granted by the Sixth Circuit, Ohio Governor Ted Strickland issued a formal stay of execution for both Reynolds, until March 9, 2010, and Darryl Durr, until April 20, 2010. Other reprieves may be granted if the lethal injection issue is still unresolved.

Peanut, how could I object to your addition to my post. I want to thank you or bringing further attention to the issue at hand. I had read the Broom botched execution in a different text format and it repulses me to read it again here in your link.

I would first want to assure everyone reading this post that my main objection to the DP is what I have just read. I would personally inject anyone who killed any member of my loved family, but only after proven guilty beyond of reasonable doubt that I agreed upon. Broom insists still that he is innocent.

I urge anyone who is reading this post to read your link Peanut, and put themselves on Brooms position and consider if the DP laws violate the 11th Amemdment against Cruel and Unusual Punishment. I think it does.

There has to be another legal Capital Punishment.

I dont. If you are in favor of executing one person, no matter how or what way or who the victim was, you are in favor of all. Currently, the US SCOTUS has yet to say if any method is "Cruel and Unusual." I believe that Ohio will work out the method and then they will be back at it soon enough.

Well if I can't pick and choose, like serial killers,terrorist, to qualify for the DP who are beyond doubt guilty.

Then I remain anti DP due to justice has executed or nearly executed way to many who were really proven innocent. Unexceptable !!
Enough innocent lives are lost already. Just adding to the bloodshed family's ruined and more victims including kids w/o a parent. What does that parent tell the child then? Oops the laws to protect us executed your mother/dad slight error?



The system failed in this attempted execution "for how many hours"??Unexceptable also.

This man should be reduced to LWOP now. My opinion.

Elric, you will laugh, i agree with you in a special context. It´s like a pregnancy, you are or you are not pregnant. When one prefers to execute DP, then he should do it in general if possible. I do the same but i defeat it, obviously in general.
To be honest, for me is it a bit hard to understand when a court names a murder cruel/inhumanely/brutal and another instance deliberates whether there could be a killing method which is not cruel/inhumanely/brutal. Sorry but i can´t see any difference whether one becomes decapitated (in Iraq), stabbed or shot dead, whether one becomes broiled on a chair or whether he becomes an injection. The result is everytime the same, it is cruel, inhumanely and brutal.

Truth is, i am FAR more likely to be the victim of a crime than to do one. Especially murder. So that is out. But when I was sick, i had IV's in me (Three) and a central line that were used to keep me alive. ALl done without me feeling anything.

I also thein the case of willie francis had the correct ennding as well, and is still viewed by SCOTUS.
