Default How long...

I've been wondering, but have been unable to find an answer, as to how much notice inmates on Death Row are given before their execution takes place. Does anyone know?

I have only had one PP murdered by the state of TX; he was given about three months notice. No idea if it is different depending on state and situation.

If you subtracted out the state of Texas, there would be very few executions in the USA, even though one is too many. I dont know what it is about Texas; the people when you meet them are lovely, but the state is a throwback to some past era that is best left there.

It varies on state as a previous poster said. Inmates can be told months in advance, but in some cases ive known inmates learn only a week before sentence is carried out.

Oh I only just realized I didn't reply to this. Thank's for the answers. I'm really shocked by the response I must admit. I mean I can't imagien how terrifying itmust be just living on DR knowing that any point you could be told your time is up, but to be given just a weeks notice, and know that each day is the last one you'll ever live...well it makes me feel extremely sad.

in the state of Georgia, USA it is about 2 weeks, unless it had already been delayed by a court and then if it lifted , it could be the very next day...but for Georgia, it is the third Tuesday in the month at 7pmEST...last one was a couple of weeks ago. Thanks for the thread

in texas they must have a minimum of 90 days for their first date but other dates are a minimum of 30 days, this is to give lawyers time to launch any new appeals etc.

however before there real date is set they will have alot of ex dates set just to move the legal process through,the average time someone is on death row is dependant on the state there in texas is now around 10 years from sentence date however california has the largest death row population but hasnt executed anyone in a long time.They are still handing out death sentences though.

imo the american death penalty is very messed up.

The 'Average' time an offender is on DR in TX is 10 years. yes, this time frame varies.

There is an appeals process. It all depends on how soon the appeals are processed through the courts and the complexity of the case.

With ANY DR Conviction, an appeal is generally filed immediately after the conviction/sentencing. This is based on the lawyer handling the case, but it is a rule of thumb to begin the first appeal immediately.

With that said, it doesn't mean the appeal will be reviewed and/or decided on immediately. The courts move slow and other cases could be in review that could ultimately effect that particular case.

My Husband was on death row, and they did not rule on his first appeal until after the USSC made a decision on another case which would in-fact effect the outcome of his sentencing.

Basically, if there is an issue with the case that is already being decided upon at a higher level, the appellate court can and will hold the case. At least in the experience I have had.

The average person in TX spends 10 years on death row. Some offenders are given several dates before the final date. When a date is given , another set of appeals and pleas begin, based on the offender. Some even get word in the 11th hours that they will be granted a new trial or a reduction in sentence.

For example, there is an offender waiting on a new trial who had at least 4 dates that I know of, finally he was awarded a new trial.

Some offenders drop all appeals and ask for a date. I don't agree with this being allowed, but it is and the state does not hesitate to stick them with the needle and insert the lethal drugs.
