You think the DP would be necessary ? Please tell me why. For what is it necessary ? To satisfy some feelings of revenge or hate ? I mentioned this thought in former discussions but donīt forget: when an offenders life is nothing worth which value would have your own one and who has to decide about ?
No doubt, there are dangerous and violent offenders who have to be punished harsh for what they have done. The society has to be protected before such people. Sometimes other inmates have to be protected too. But where is the justification for DP ? What does such a punishment change ? The answer is simple and hard: DP changes nothing.
I have a comparison in my head which is really hard to decide, especially for americans: Timothy McVeigh. What should a society do with such an offender ? A progressive society would give him the smallest amount of human rights, the right to live. Take a look to UK to Peter Sutcliffe, he got it. Like ASE said, itīs his own decision in which circumstances he can do it, it has to start with the hardest ones.
The question is not whether DP is justified or not. DP changes nothing thatīs why the question must be: what are the circumstances which led an offender to his crime and what has the society to change in relation to the circumstances. I guess we would end up very fast on social issues.
Btw. i have some serious doubts about what you wrote that no stone would be unturned to give an offender the opportunity to defend himself. Maybe you should experience the texan law on parties to become a new point of view. I hope in near future the american law system will become an urgent required reform, in some points is it simply outdated. |
