Former prison guard gets probation in death of inmate

PLAINVIEW, Texas (Map, News) - A former prison guard charged in the death of an inmate whose head was slammed against a wall pleaded no contest to manslaughter and was given the minimum sentence by a jury that said it would have acquitted him.

This type of thing is not all that uncommon in US prisons it is fairly easy to see why most prisons in rural areas that depend in he prisons for their economy .Most of the population knows some one who works at the prisons and have the mentality that the prisoner “deserves” what ever guards see fit to dish out . So they are unlikely to punish a guard
Also there is a belief in the US that prisons are full of sociopath killers , rapists and child molesters . so most of the population could care less what happens .This is in part due to the media that of course shows the very worse it is sells and makes money . Then there is the news media that headlines some sort of horrific crime an it has the effect of people thinking that there is some sort of massive crime wave and every felon is a depraved lunatic ready to do anything imagine

In TX there are several towns such as Gatesville and . Huntsville that without many prison and both a have a lot Gatesville has the largest concentration of female prisoners in the world . The residents are highly unlikely to turn against their own and their financial interest that is chockfull prisons . It is a vicious cycle that I would be happy to go into . In TX any ways TDCJ is the largest employer so they have lots of clout and ability to do as they please . All at the expanse of ALL US taxpayers as the feral government gives out a lot of money to prison towns and the large population has a huge effect on elections prisoners cannot vote but count as residents of that county or town as the case maybe and they are by definition indigent so that means even more federal tax dollars and clout .a basic explanation. But hopefully an idea of why abuse by guards an staff in prison goes unpunished ..

What really worries me is it sounds like the jury had made up their minds and felt like "why are we bothering with this and the man should get off totally." That may or not be the case but as jurors you have an obligation to listen to the trial and not walk in there having already rendered your verdict!

They should have asked for a change of venue.

LULU yes prison towns are very pro prison .They make a living off of it that does not make it right though .Just harder to change things .

I’m not making any assumptions about what happened exactly but the fact that the victim was handcuffed at the time is a little bit suspicious. It seems EVEN if he had kicked this CO in the groin, was there no way to subdue him without slamming his head into a cement wall? Its seems like overkill....

Well, I'm not a man but unfortunately, I've been in a position to feel the need to kick a man in the groin and let's just say they don’t react well to it. If you attempt to strike them in that area, and miss, heaven help you.

So the conclusion I would need to come to (having not sat through a trial and only privy to the details available to me from the article) is that this inmate tried to disable the CO in some respect and he panicked and used MUCH too much force. I totally agree with you though it was excessive. I’m just trying to come up with a potential scenario and what might have occurred.

Only in Texas, they are so short of prison guards I guess they could not let one of their own be on the other side.
