Man convicted of stalking, killing ex-girlfriend executed

A West Texas man who stalked his ex-girlfriend after their breakup was
executed Thursday evening for raping, strangling and using a claw hammer
to fatally beat the woman.

"I love y'all and I'm going to miss y'all," Gilberto Reyes said with a big
grin on his face in his brief final statement.

Reyes, 33, had no witnesses on his side of the death chamber. He never
looked at the parents or other relatives of his victim, who watched
through a window.

He was pronounced dead at 6:17 p.m.

When the parents of 19-year-old Yvette Barraz reported her missing after
she failed to return home from work, police wanted to ask Reyes, her
ex-boyfriend, about her disappearance.

Reyes already was known to authorities in Muleshoe in Bailey County along
the Texas-New Mexico border about 70 miles northwest of Lubbock. A month
earlier, Reyes had chased Barraz around town and took a shot at her with a
rifle.

"We certainly wanted to find him and visit with him," recalled Don Carter,
the former Muleshoe police chief. "I don't think you have to be in law
enforcement to figure that deal out. And the fact was we never could find
him, which just made him even more so a suspect."

Two days after she was last seen, Barraz's battered body was found stuffed
under clothing in the hatchback area of her car some 450 miles to the
south in Presidio, along the Rio Grande across from Mexico. She'd been
beaten with a claw hammer, strangled and raped.

It would take another nearly 3 months before police arrested Reyes in
Portales, N.M., about 40 miles west of Muleshoe. When picked up, he was
carrying keys to Barraz's car and home.

Lawyers for Reyes filed suit in federal court challenging the Texas lethal
injection procedures as unconstitutionally cruel. The suit was dismissed
by a judge in Houston.

Blood evidence found outside the restaurant where Barraz worked led police
to believe she was attacked there as she left work the evening of March
12, 1998. Then before dawn the next morning, border police questioned a
man identified as Reyes as he was walking toward Mexico across the
International Bridge at Presidio. He was carrying as much as $100 in coins
but authorities had no reason to detain him and allowed him to continue
into Mexico after a background check showed no warrants were out for him.
They later speculated the coins were Barraz's tip money.

"The sad part about it was he crossed over by the time she was determined
to be a missing person," said Carter, now a captain with the Lubbock
County Sheriff's Department. "So we were just behind him, and since he got
across the border, it delayed apprehension."

At some point, Reyes returned to the United States. Acting on a tip,
authorities arrested him June 7, 1998, in Portales.

At his trial, witnesses told of Reyes and Barraz having a stormy
relationship. A police officer testified Barraz had complained about Reyes
stalking her 2 weeks before she disappeared. DNA evidence from Reyes was
found on the victim's clothing.

A Bailey County jury deliberated about two hours before convicting him of
capital murder. They took another 2 hours before deciding on the death
penalty.

"She was a beautiful, vivacious, respectful young lady," Victor Leal, who
ran the Muleshoe restaurant where Barraz had been working about three
months, said this week. "I regret the fact apparently he'd been stalking
her and she did not tell me that.

"I've always looked back and thought if I had taken time, sat down and
known her a little better, maybe she would have shared that with me and I
would have done something like make sure she was getting walked out to her
car."

Leal, a former mayor of Muleshoe, said the slaying was a jolt to his
community.

"When you have an employee abducted and attacked and eventually killed in
your own parking lot, it takes away what you perceived was some safety in
a small town," he said.

Wednesday evening, Rodriguez, 36, apologized profusely and sought
forgiveness from his victim's family before he was executed.

"You have every right to hate me," he told them. "None of this should have
happened."

I do not see how any one can watch a execution ? It is not going to bring back the victim and it seems stooping to the level of the killer.
Watch I do not think I could watch someones life be taken. It would probably mess me up even more and I do to see how it is closure . . It is revenge not justice let the guy live his miserable existence in prison . I saw a dog get hit and killed and was bothered a lot by it a few months ago never mind a human . it is something that is disturbing to me that people would go and watch a execution . There is something I cannot quite place that has long bothered me about that practice . it too is to eerily close to Nazi Germany and shows how we are degrading each other . Now another family suffers what is enough? The family was not involved in that person crime . it just perpetuates violence .
I can see a some one who a loved one of the condemned exacting revenge on the victims family . I am sure it has happened if I can think it then it is entirely possible some one else has and acted on those thoughts .
I know there are families who are victims of a capitol murder and also saw a the execution and now are against the Death penalty .


He can be punished inside no contact , no mail except a attorney maybe family . If they request researhers and media so that a case can e looked into . . no television nothing if it is capitol murder . Some people are evil any one who plans out a rape and killing is among them death is too easy an we should not be giving the state the power to take a life . we can release a live person if found innocent and at least pay them a lot for the grave error we cannot bring back a innocent person who has been executed.

The problem not with this loser but with others is the innocnt people on death row probably more than in the rest of prison due to the pressure for a conviction and cops and DAs lying hiding destroying evidence and all kinds of "fast track legislation " in a rush to execute . it gives me pause to think is the state afraid it will be caught executing a innocent person is it afraid of appleals so that the person life is spared and they exonerated ? The state cynically uses the victims grief victims to say well they ned cluser as fast as possible and all these appeals cause them grief and make them relieve the crime .

yes this loser is gulty but he in the end even after a brutal death wins he is gone out o the hell that is prison . and if their is a innocent person executed what then execute until we hopefully get the guilty party and drag out things even more fro the victims? . can the family of the innocent person take both he state all those who did anything including withhold exculpatory evidence ,lie ,on the stand to be sure of sure of a execution and the familys who happily watched and even encouraged the death of a innocent person .interesting moral question . what should happen ? if we follow the logic of the death penalty ....
I for one would not want any involvement if in fact the person was innocent i wonder how those hate filled revenge people can live with them selves knowing a innocent person dies to make them happy ? now who has the moral high ground ?

Thea AMA has stated it will revoke the license of any doctor who participates in a execution a interesting thing as it is highly illegal to posses the drugs used they are extremely dangerous chemicals and only one is used routinely that is Pancroinium (SP) you will get it in general anesthesia during surgery so the surgeon can do their thing .
it immobilizes you but you remain alert and awake if you are not anesthetized. the anesthetic sodium pentothal is now a outdated drug other more effective drugs are used . It is a drug that requires a highly trained anesthesiologist to administer correctly not some flunky who lacks any training . Other it was originally used a fro general surgery other more effective and safer drugs are now used .

next they use potassium chloride to cause cardiac arrest , the heart does not stop beating but instead goes into defilbations and also is very painful one feels as if their chest is burning . up and being clamped in a vise .
It is to just like "putting a animal to sleep." we use th is to make it more palatable .

Some of the prison staff are sick and put the chemical into a freezer fro a few minutes prior to injection so the condemned feels ice cold running into thier system .
it is horrific . just because they if guilty committed a brutal act does not mean we should torture them in return it makes us worse than them



Besides death is far to easy even if it is a crueol way to kill it is in fact it was not even thought up by doctors no it is the same as how a animal euthanized

It was made to delibertaly be cruel the inmate is aware of everything until the potassium chloride causes a massive heart attack that is excruciatingly painful the sedative used is no longer used medically

a pet is given a lethal does of phenobarbital . along with morphine to sedate and ease any possible pain usually none is felt also used is midazolam a highly potent benzodaizapine used as a anti anxiety and sleep aid put side of the US . It is used only in injectable from in the US . it is called versed. to enhance the morphine pentobarbital stops breathing slowly and they pass away ,respectfully and peacefully unconscious .

Not so with lethal injection some one knew it would be brutal it just seems more humane .Because it is called a lethal injection and society equates it with "putting a pet to sleep" nice we even then do not say we are taking the pets life . a very difficult to do and humane act as it should be .

Makes me wonder what type it takes to be part of the execution,,, like ASE,,, even though it is done to animals dying and death is near it was hard to watch,, but,, I stayed with them knowing my pets whated me with,,, and smart enough to know,,, they first put them to slept,,,and when sure ,,,,then admimister the injection that stops the heart,,, they all died of or dying from old age,,

Despite what the person did,, I still do not know how they can be so calculated,,, and go home and sleep and enjoy a meal,,, even the victims ,,,,how that could give them peace,,,it would give me the opposite,,, I am sure,,, even if it was a loved one of mine,,,it would just make me more ill,,, and violence and the smell of death again in the air,,, thats me though and my opinion and personality ,,,,,,, ,,I cannot even stand to see a dead animal on the road hit by a car ,,, ruins my day,,, I once saw an animal fall out of the bed of a pk up trk,,, a German Shep,,, which died iimmediately,,, back some yrs ago on my way to work,, it upset me the rest of the day,, so that coming wk end went to the pound and found a beautiful Ger Shep,,, and took home ,,,actually loved to 16 yrs old ,,,it made me feel better ,,,,,to have helped this one have a loving touch and a home where secure,,,,, sad,,,that one can cold,,, clinically,,, purposefully ,,, vendictively ,,, use the DP ,,,which is not as humane a method used on animals.......to boot.....

not every on is this way .But those who are "primed" to be will gravitate towards jobs such as cop Co Warden DA etc they are usually different than the average person with a rigid mindset that makes it easier to commit the atrocities they do . not all s do . it is not well publicized that DAs have a high drop out rate once a young newly minted attroreny finds out they are actually exacting revenge regardless of guilt or innocence they do stop .Many become defense attorneys my second attorney was a ADA at frist .now she is anti death penalty , anti mandatory minimum sentaences wary of plea barins . thinks itshoildbe illegal to use athe testimapny ofa person who gota lessersentace in exchange for thir testimaony ifshe had her way it would not even be suffient fora wrrent . in conversation she said to me once . they will say what ever they think we want othear . they will lie even na,ea non involvedpaeron or persons just ot get a lesse sentance . or make up a whole story . she wonders if she has not sent innocet poole to prison fpor simply knowing the person . She told me that some of the most evil people alive work as cops DAs Cos and professional; snitches .Trading in lives leaving behind a endless river of tears and unending heart ache . all to make thenmsleves feel as if they are doing "good" . . A capitol jury is stacked by it's nature . If you are honest and tell them you oppose the death penalty you are automatically struck form the jury . So it follows that only DP proponents who are also cop "The heros" lovers and believe the person to be guilty in the first place or they would not be on trial. I think what is what I have been trying to say. I do think many go inside with some sort of psych problem to begin with part of how they got there is the psych problem.. Mental health problems cuase the person to be at some level alienated from a lot of society .iand inclined to commit crime if only to get by or to use a drug to escape the torment that their life is . I was one of the very few. But I had /have them now . (Sarcasm Alert ) out

I am really sick of the self-righteous holier than thou aholes who say stop blaming society they are the only ones responsible. There are so damn many holes in hat argument I could rive a tank trough it .

It is only logical if we hold inmates treat them as less than human find the most petty and vindictive ways to harass them . I felt it every damn day . From the get go. From my arrest to the day I left in fact the sadistic Co would not even let my then 90 year old grandfather walk ot the door and hold a down jacket he bought for me as it was cold out I had to walk 1/2 mile in 1 10 temps with wind blowing in a ts hirt and light weight prison khakis . I know it was just another way for them to get in one last bit to torture
The stress is extreme and lots of problem result I live with them everyday. . guard are sadistic to the core and I believe they really have lost any sense of humanity they had I read something elsewhere and it was ok until the Co justified the thought or need to shoot with buck shot a inmate if they tried to escape with the bible le he gave more insight into his character in those few sentences than years of research could dig up . He did not really care or value that life or the life of any inmate even if it was a escape attempt he would kill and probably enjoy it knowing he could seemed to give the man some feeling of superiority . I was not really surprised. I was nauseated by his false sincerity and playing his audience . In the end he is worse than those he watches over.
Now after few letters and reading I see my friend in Gatesville might out any time soon despite her hopes . I feel awful about it .why tell some one you can be out only to deny it ? That is sick and utterly inhumane, it does affect others some one who she just met who has nothing to do with her past and believed the TDJC when it stated she would be pout soon on their site! . if you say your going to do X damn it do it . Don't let some one get their hopes up only to crush them for some perverse pleasure that is as low as a child molesters . Sick and why? I just saw where a dumb cop and he was dumb walked up to a open window and sprayed mace in got shot to death if he had been smart would have approached as is policy from the behind and stood where he was not a target . well some guy shot the man who shot the cop no charges were filed even though it was after the fact not in self defense . No that is disturbing .a cop is that much more valued by the state than us that means all of us that if they get shot at any one can dispense justice they see fit? I think the guy who shot the man should face murder charges he is not a hero as he is being hailed in the press . But a gun freak who wanted to kills some one and did as he saw not a cop and suspect he saw cop "almighty untouchable Hero" get shot by evil criminal scum so he waked over after the incident and shot the guy he did not call 911 did not help the cop on the ground no he shot a man in cold blood and got away with it though he is facing civil suit wrongful death . It is disturbing no charges are filed that is vigilante justice at it's worse . But because the guy shot a "hero Cop" it is ok to Kill now if youi think the person did something to a cop making them untouchable and above the law and worse "heroes " is dangerous and once again one step closer to a police state .

It is this mentality that makes it possible the fear spewed by right wing blowhards like Limbaugh who has the audacity to demand druggies go to the big house . thgne get caught with enough oxycontin to keep NYC high foa year ! and the his getting caught with viagra w/o a X lets see you do that oh there is a reason he wnet to the Dominican Republic with viagra . and it is very illegal the Dominican republic is known among peverts for its sex tours I'll let youi take it from there .
