Default need help! time cut & writ

hi there - I need some help!!! my special PP is trying to file a time cut and a write of habeas corpus...he does not have money for a lawyer and had a crummy public defender. He has been locked uo since 1996 and is up for parole in 206. is there anyone that can help him with filing all of this? does anyone know anything about this or have been through it before?

he should spend as much time as he can in the law library and if they have it use westlaw to look up how to do this any one can file a writ of habeas corpus it simply means the body is wrongly held. You cold hep by going on line to Westlaw and paying to use the site it is not cheap not sure of the top of my head but it will give you all you need . it has a search engine and you can print out things . It also has a legal dictionary that is very helpful I do not know but I think Barnes and Noble or Amazon have them you can have it shipped to your PP

You might your self be able to find something at a library copy it an send it . also there are legal aid organizations try witting them and calling until you get help for him usually one in his state or a national one I would do a google search if you have the time

I would research to see if he is able to obtain any legal aid. When filing the writs they are very anal about them and they have to be perfect or they won't even consider them.

What state is he in?

Skye is right they have to be perfect I think Westlaw has a example of one and usually each prison has to give you the proper for We had Legal from at the CO desk and we would have envelops from our lawyer .
If he has a lazy or incompetent public defender . that is ano the matter he would need a attorney that he paid for or does pro bono work
perhaps if you can afford it and can talk it over with him you can post a ad for pro bono help .

Also some law schools require some sort of legal experience . with a practicing attorney . of course they cannot for some twit who wants to be a prosecutor . to defend some one but most law students do not have any intention of working at a lower wage for the state . . That might be a few ideas .

A lot depends on the crime he is convicted of , the state Texas, Florida perhaps Georgia and Virginia and are two of the worse for appeals , Writs of Habeas Corpus and other petitions . So the politicians can show how tough they are on crime .That is until they IE Tom De Lay get caught and the instantly discover the bill of rights and exercise it vigorously

Westlaw is extremely cost prohibitive for average people, especially those who are inexperienced in using the data base and therefore spend substantial time accessing it. Same thing goes for Lexis.

Much better options for inexperienced researchers are Loislaw and Fastcase. For less than what Westlaw or Lexis would cost for a full day of research and average page retrieval/printing one can get an entire month of unlimited access with unlimited page retrieval/printing through either.
