| I am told that the US Supreme Court handed down a decision some time ago regarding the rules that state DOC's are allowed to impose upon inmates. From what I can gather it was a very definitive decision and was originally related to whether or not an inmate could "advertise" for Pen Pals...but it was written so broadly that it reflects on many other rules. I have tried a number of different ways to find this decision but without success. Does anyone here know of that ruling or where I can find Supreme Court decisions without the decision number or the name of those involved in the action...ie: Joe vs Texas DOC.? Thanks for your help. | Tom, I'm not familiar with anything re: the supreme court and inmates advertising for penpals. Aside from the obvious ban in FL and an attempted ban here in AZ back in 2003, I've not seen anything else. I'm pretty current with what goes on in the supreme court (uyou have to be these days) and even seached the website for the USSC and didn't find anything regarding it. Now I'm not fallible and if I am wrong I do hope someone would correct me, but as it stands right now, there's nothing I've seen about this on a federal level.

| From what I have been able to find out, someone somewhere took a DOC (Texas????) to Court over rules regarding inmates free expression rights. The Judge said that a DOC could not just make up rules because they felt like it...that DOC rules had to relate directly to the safety and good order of the institution for both employees and inmates. So a DOC could make rules that say you can't send a letter into an inmate with directions on how to make a bomb...but the DOC cannot prohibit an inmate advertising for, or receiving mail from person or persons unknown. Makes perfect legal sense to me...but I'll be damned if I can find the actual court record of this decision...if indeed it really exists!! Tom
