I know someone who is serving 7 years for a gun. the Federal people took over his case instead of the State. Is this constuinal when a person can kill someone and get 8 years. please advise.

Something like that is HIGHLY dependent upon a number of factors not presented here.

State laws regarding sentencing is one key issue. The protocol between the State and the Federal government is yet another.

More specifically, the elements of the crime itself will often dictate what type of sentence is handed down.

That question simply cannot be answered without MUCH more information.

The police rode down our street and arrested 3 guy one is which is my son. They did not find the gun on either one. but one guy got probation and my son wanted to fight the case.
