Re: MARRIAGE in TDCJ PRISON - ANYONE? In my case, We did not have to have the marriage approved. In fact, the Chaplin's at the unit both told me that the prison are not supposed to have anything to do with the actual marriage because of the high divorce rate. They can not condone it or be against it, they have to remain neutral. There is a proxy form that has to be filled out by the offender. Once he fills it out, you take the form and the person he names as his witness, and you go to the court house. They give you the license, you wait 3 days, and go before the justice of the peace, or any one who is able to actually preform the ceremony. They do the ceremony, then they take the license back to the court. The court mails it to you. In my case, a little sweetness went a long way, and the judge who married us walked it to the clerks office with me and they had me come back in a few hours to pick it up. You must indicate to the court that you need a CERTIFIED copy of it. In order for TDCJ to recognize the marriage they MUST have the original or a certified copy of the certificate.
You mail the certified copy to INMATE RECORDS and send a short note that you were married to offender so and so , TDCJ # 123456 (whatever the number is) and that you need your status changed.
