Default he was denied parole (again)

Is it possible for the pb to deny parole for the same reason as last time? What are the chances of apealing this? Is it worth fighting, or just a lost cause? I'm so fustrated.

A Parole Board decision generally cannot be "appealed". If the denial is based on facts the first time that still exist the second time, a secondary denial would naturally follow suit.

Obtaining parole, statistically, carries about a 1/10th of a percent possibility in the first place. That means one out of a thousand might be granted parole status the first time the prisoner becomes "eligible" for "consideration". The odds are better the second time, third time, etc.....but is still considerably difficult to obtain.

Parole is not a right, but rather a privilege. It is a complicated process, and many aspects of the original offense, conditions and behaviors since incarceration, and compliance with post-incarceration requirements play a very large part in the consideration by the Parole Board.

BBG, I understand your frustration. For YEARS, I went to a parole board hearing for one of my pps (the parole board remembered me from year to year) and every single year he was denied due to the "nature of the crime." Okay, will that EVER change? So what's the point of even going? It made me fully identify with the offender in the movie "Shawshank Redemption" when he went before the parole board.

I think the chances of getting parole are equivalent to the chances of winning the lottery!

i am really sorry that you mate got denied again. what are your plans now? what is he in for, and do you think that parole will be granted at any time? ah i am sorry - hope things get better for you.

Whelp, I just dont understand, 4 years good time, he is working, has trade certificates, just went down to a level 3, this is nuts. What makes things worse is his sons mother is in jail, the aunt caring for him was just in a bad car accident (in critical condition) he dont know where his son is. So its been a very stressful few days for us both. I appreciate all the help/comments from everyone! Now we are keeping our fingers crossed for a transfer (which will really help us both for visits) Anyway, we are ready to fight fire with fire, but I just dont have any faith in the "system" Thanks again~ Danielle

one more thing, someone said there is a new law that the PB can not deny parole for the same reason as before from a prior hearing. This is in the state of VA ~ anyone ever hear of that?

just spoke to him, his councelor had help up his paperwork, so when he had his hearing, all the good information that would of helped him was missing GRRRRR!!!!!!!!!

I am assuming the words are "held up" not "help up"....in which case you may have something to move on.

Obviously LawDog will know better and maybe will weigh in again given this information...but it seems to me that if the Parole Board made the decision without having all of the pertinent information available to the members of the panel, that there may be somethng that can be done to get them to look at it again.

Just my thoughts

Thanks Tom, and I do believe that it does call for automatic appeal. Not 100% sure thou, but I pray it does.
