My boss received an adversary proceeding no. 02-10032 and is supposed to "provide the court with their written positions on the status of this proceeding as core or non-core, including whether they consent to the court's proceeding under 28 U.S.C & 157(c) (2) with the court's judgment subject to review by way of appeal under 28 u.s.c. & 158 instead of the court's proceeding under 157 (c) (1); and to advise the court whether they consent to this court's ocnducting a jury trial under 28 u.s.c. & 158 (e). It is saying that her company has not complied with the courts order.
They were told by an attorney that it would cost $3,000.00 to take the case. They don't want to do that. Other defendants are responding with a praecipe. Can you do that without an attorney? She really doesn't have 3 Gs for this. The gist of this case is a previous client for my boss' home inspection co. is sueing everyone involved with a project that the inspector took himself off of because he knew this was a law suit waiting to happen. That is also why he does not want to pay a lawyer, he thinks he should not be involved and wants to get taken off the case.
