Default FALSE IMPRISONMENT-EXPLANATION

The Supreme Court's liberal decisions in the 1950s and 1960s in the area of prisoners' rights encouraged many incarcerated persons to file writs challenging their convictions. In recent years, the Court under William Rehnquist has limited multiple habeas corpus filings, particularly from prisoners on death row.

False Imprisonment,complete restraint upon a person's liberty of movement without legal justification. Actual physical contact is not necessary; a show of authority or a threat of force is sufficient. The person falsely imprisoned may sue the offender for damages. The suit would be brought against officials improperly...

Complete restraint upon a person's liberty of movement without legal justification. Actual physical contact is not necessary; a show of authority or a threat of force is sufficient. The person falsely imprisoned may sue the offender for damages. The suit would be brought against officials improperly issuing warrants for arrest and against private persons for any illegal total restraint of liberty.
