Default Deportation

Does anyone have a PP who is facing deportation? My special PP is facing deportation if he makes parole, any help or info would be much appreciated, I mean it is hard enough being seperated by walls but to be seperated by a continent is almost unbearable.

Mine got deported back to Panama for the second time,,but the first time was pre 9/11,,I told him if he crosses that border again he is not going to get out so fast the next time.
He is adjusting well,,back with his oldest sons Mother and got a pretty decent job. He sounded happy to be free after 9 years of imprisonment but still worried about his future.
Added note dont even count on parole as a means of him staying. My friend made parole and the week before he was to be released INS came at 3am and put his butt on a plane.

Typically, they deport them after release. They can reapply to come back into the states. Based on how their deportation is classified they have to wait 5 or 10 years to re-enter legally to the states.

In a few but rare cases, I have known 2 inmates who faced such deportation, but were able to legally fight the deportation due to family and children being in the states. This was before 9/11/01.

Now, it is much harder to fight deportation. Homeland security and USCIS have changed the immigration laws and it is very difficult to get a loved one in the states without the prison and deportation variables. Once you add just one of the two it is a struggle legally and financially.

I am going through the immigration process at the moment with no variables added to our situation, and it has at best been a financial strain. Between filing fees and translation fees I don't even see my pay check each week.

If your pal wants to fight his/her case, the only way to have a fighting chance is to hire an immigration lawyer, but keep in mind with a criminal past/record there are no guarantees.

Thanks Skye, he moved to the states when he was 6 and this country is all that he really knows, he has been in prison since he was 16, and he has been in prison for 16 years, his family is here in the states and I am sure it would be difficult to go back to his country, I think I will meet with an
immigration attorney and at least get the basics, cost is no problem, I would just want him to be able to stay.

I wish you well, the process can be a headache.

If he was here as a legal permanant resident, the lawyer may be able to help, he would have a stronger case if he had children of his own.

If his family never processed him as a legal resident, he is going to have difficulties.

I would speak to a lawyer and find out where to go from there. Good luck

Although one of the early foundations of the US was immigration, there are now many laws in place and if someone isn't here legally that is the term society uses for them.

There seem to be laws for everthing 'eh

He has been here legally since he was 6, he is from Tonga, I am looking in to meeting with an immigration attorney, it seems to me that if he was here legally they should not be able to deport him but from the minimal information that I have seen, because of his charges they are deporting to him, the last parole hearing he had they said that if they decide to depport, and interestly they will not depeort him to Tonga but to FIJI, but after deproting him he could reapply to come back to America in 2 years, so I guess I will have to see if an attorney can help us, keep yor fingers crossed!
