Ive seen them tried both ways. Im not sure who makes that final decision or if its a motion put forward by the prosecution or perhaps is dependant on the crime and the laws in the state.
Juvenile court is leniant in most cases and kids can walk at 21 for murder/rape....a slap in the face to victims.
