I have been trying for 12 years to appeal my conviction of Murder. I never intended for anyone to lose their life. I regret (2) people lost their lives, but I believe I should have been tried for some form of Manslaughter, not Murder. I didn’t intentionally set out to kill anyone. I’m not innocent of committing a crime and I completely believe I deserve punishment, but (134) years is excessive.
My adult record consists of: Unlawfully Carrying a Firearm, Possession of Controlled Substance (State Jail Felony), (2) Driving While License Suspended and a Driving While Intoxicated. I’m not a bad person. I just made some irresponsible choices. I’m serving (134) years for (2) Aggravated Robberies and (2) Murders. I received (99) and (40) concurrent sentences for Murder during trial and as a Plea Bargain, I received concurrent (35) year sentences, which the judge stacked on the murders.
My appointed attorney provided insufficient representation during and after my trial. He filed a motion for a new trial but failed to file the proper motion for my appeal, He did, however, state in his Motion to Withdraw Counsel that I had indicated I wanted to appeal my conviction. I’ve had (2) attorneys appointed to represent me on my appeal and neither took the necessary steps to guarantee I received Due Process.
