After 32 years in prison, for a crime that never even happened, I have found a 100% reversible error, a JURISDICTIONAL DEFECT.
They convicted me of felony murder by the crime of arson (People v. Densmore, 87 Mich App 434 (1978)), but it was the arson of a car. Per People v. Reeves, 448 Mich App 1 (1995) the only arson that can support a felony murder conviction is the arson of a dwelling house. Thus I could not be charged with nor convicted of felony murder.
Charging me with felony murder was prosecutorial overcharging/misconduct and per People v. Vannoy, 106 Mich App 404 (1981) a JURISDICTIONAL DEFECT that requires reversal.
Ideally I would like to find one lawyer or one law firm to take my case and represent me in the appeal, the trial and any possible civil action afterwards. Factually and legally, this was an accidental death. The Arson Expert testified: “I found no evidence of how the fire was set”. See: Klatner v. Pebbles, 628 F. Supp 96-97 (1986).
I have no funds to pay you but shouldn’t there be compensation for the years of false imprisonment?
